JUDGMENT

[1]The respondents have failed to file any ET3s Grounds of Resistance in these three cases.[2]Having considered the ET1s, EJ Burns has decided that a determination of the claims can properly be made without a hearing and the Judgment of the Tribunal, made under rule 21 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, is as set out below.[3]The first respondent has unlawfully failed to pay wages to the claimant. The tribunal orders the first respondent to pay to the claimant £7,036 gross, less any deductions required for income tax or national insurance contributions which should be paid to the HMRC accordingly.[4]The claims against the second, third and fourth respondents are dismissed because the claims for unpaid monies can only be brought against the claimant’s employer which was the first respondent.[5]No further hearings will take place in this case.
