Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has failed to file an ET3 Ground of Resistance in this case.[2]Having considered the ET1, EJ Akhtar has decided that a determination of this claim can properly be made without a hearing and the Judgment of the Tribunal, made under rule 21 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013., is as set out below.[3]The respondent has unlawfully failed to pay wages to the claimant in September 2023 as follows: a) £733.33 gross (|The claimants gross monthly pay is £2666.66- the Respondent has paid her £1333.33 in September 2023 and £600 in February 2024=£733.33 outstanding).[4]The tribunal orders the Respondent to pay to the claimant £733.33 gross (which should be subject to deductions for any tax and national insurance for which the respondent should account to HMRC).[5]The hearing listed on 8 March 2023 is cancelled.
