Ms S Cuthbert v North and South Arden TMO Ltd: 2215308/2023 and 2200616/2024
JUDGMENT
[1]The following complaints were presented out of time:a. (Claim 2215308/2023) that in April 2021, the Claimant’s colleague Mr Channing gave their manager Ms Powell a broomstick, a book of spells and a picture of a witch and that this amounted to sex-related harassment; andb. (Claim 2200616/2024) that in August 2021 the Respondent rejected the Claimant’s complaint dated 5 July 2021 and that this amounted to direct sex discrimination and/or sex-related harassment.[2]The Claimant stands no reasonable prospect of success at the full Hearing of persuading the Tribunal to extend time in relation to these complaints. The Tribunal does not have jurisdiction to hear them and they are accordingly struck out.
