The claim is struck out.REASONS
[1]There were two Preliminary Hearings listed in this case. The first was by cvp, on 25 October 2023. The claimant did not attend the hearing. The Employment Tribunal Clerk spoke to the claimant who said she had moved, had changed her email address, and did not have notice of the hearing. Later attempts to call the claimant failed.[2]Despite the claimant knowing at the latest by on 25 October 2023 that the Tribunal had been communicating with her, at no time has she updated her postal address or email with the respondent and the Tribunal.[3]I note that the respondent has been communicating with the claimant at her email address as specified on the claim form. At no time has the claimant indicated she wants another method of communication. While she may have changed her email address, she does not suggest she can no longer access the email address she specified on the claim form.[4]The Tribunal wrote to the claimant and respondent on 28 October 2023 stating that there would be a preliminary hearing at Central London Employment tribunal on 15 January 2024. The claimant did not attend this hearing.[5]It therefore appears that the claimant is not actively pursuing her claim, becausea. the claimant was aware at the latest on 28 October 2023 there was a tribunal hearings 6.2 Strike out Judgment – claim - rule 37 Case No: 2212993/2023b. the claimant answered a call from the Tribunal and spoke to the Tribunal Clerk on 28 October 2023, however, she did not answer subsequent calls or contact the Tribunal when asked to do so later that day.c. the claimant says she has changed postal and email addresses, but she has not updated the tribunal with her change of address I therefore conclude that the claim should be struck-out on the basis that it has not been actively pursued.
