JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has failed to file an ET3 in this case and has stated that they will not be defending the claim.[2]Having considered the ET1 and correspondence from the claimant, Employment Judge Smart has decided that the claims for, unfair dismissal, a redundancy payment, breach of contract (notice pay and expenses), arrears of wages, and holiday pay succeed.[3]The remedy to which the claimant is entitled will be determined at a Remedy Hearing. __________________________ Employment Judge Smart 7.11.2023[1]The respondent shall pay to the claimant the net sums of £4,822.50 in respect of redundancy payment and £3,581.56 as a compensatory award for unfair dismissal.[2]The respondent shall pay to the claimant the gross sums of £4,000 in respect of unpaid salary, £2,030.77 in respect of unpaid holiday pay, £56 in respect of expenses, and £4,615.38 in respect of notice pay, subject to deductions for tax and national insurance.[3]Any sums paid already by the respondent’s liquidators shall be deducted from the sums to be paid under this judgment. _
