EMPLOYMENT TRIBUNALS
Case No 2209963/2023

Employment Judge L Cowen (sittingNot represented for claimantIn person for respondentDate 8 November 2023

JUDGMENT

[1]The claim is dismissed due to the non-attendance of the claimant under Rule 47 of the Employment Tribunals Rules of Procedure 2013.

REASONS

[2]The claimant did not attend the Final Hearing listed for 20 October 2023.[3]The Tribunal staff made several attempts to contact the claimant by telephone. She had not provided an email address to the Tribunal.[4]The Notice of Hearing had been sent to the claimant, but details of how to join the hearing had not been sent to the claimant, and so the Tribunal tried to contact her, and queried whether she had made attempts to contact the Tribunal. There was no information suggesting she had tried to contact the Tribunal. Case No: 2209963/2023[5]The Tribunal waited for some time to allow the claimant the opportunity to attend the hearing, contact the Tribunal or to respond to the tribunal’s attempts to contact her. No contact was made.[6]I am satisfied that the claimant was aware of the hearing, and note that she has not responded to communications from the Tribunal in relation to case management issues. Taking into account that it is for the claimant to establish her claim, and having regard to the overriding objective, I dismissed the claim having regard to Rule 47 of the Employment Tribunals Rules of Procedure 2013.
