JUDGMENT
[1]The correct respondent is as above and claims against Ten Alps Publishing Ltd are dismissed.[2]The respondent unlawfully failed to pay contractual notice pay of three months to the claimant and the respondent is ordered to pay the claimant £12,500 gross (£9,116.94 net) less £798.13 for arrears of pay and £479.00 for notice pay already received from the Secretary of State.[3]No order as made in respect of unpaid holiday pay as a payment has already been received from the Secretary of State.[4]The respondent was in breach of its duty to consult representatives under Trade Union and Labour Relations (Consolidation) Act 1992 section 188 and a protective award of £12,362.66 representing 90 days’ pay is made against the respondent which the Tribunal understands will be payable by the Secretary of State.
