JUDGMENT

[1]The claim is struck out and dismissed.

REASONS

[2]Having reviewed the tribunal file and noting that the claimant has not responded to the tribunal as directed by EJ Burns on 9 February 2024 and noting the complete absence of activity in relation to the claim by both parties and noting that on 9 February 2024 it was observed that the first respondent was in compulsory liquidation and that the claimant had not received permission from the insolvency court to pursue her claim at that time, I have formed the view that the claimant has failed to indicate to the tribunal whether she intends to continue or withdraw the claim as directed, has not informed the tribunal that she has the permission of the insolvency court to pursue the claim and that the claimant has not demonstrated any intention to pursue the claim any further. Accordingly, I direct that the claim struck out with immediate effect.[3]In particular, it appears to me that the tribunal does not have jurisdiction to hear the claim against the first respondent on the basis that the claimant has failed to v3 10.2.25 1 Case Number: 2208069/2023 demonstrate that she has obtained the necessary permission that she requires from the insolvency court given that the respondent is in compulsory liquidation.
