JUDGMENT
The claim is struck out because the Claimant is not actively pursuing her claim.REASONS
[1]According to correspondence received from the Respondent and copied to the Claimant, the Claimant has been failing to comply with case management orders made in this case since March 2023. This was acknowledged by the Claimant’s representative at that time. The Claimant provided partial disclosure of documents in two tranches on 19 and 24 May 2023 some two months after the deadline set by the tribunal.[2]Despite making efforts to contract the Claimant’s representative since then to agree a bundle, the Respondent has not had any further engagement since then. It has therefore applied for the tribunal to strike the claim out, copying in the Claimant.[3]By a letter dated 13 July 2022 the Tribunal wrote to the Claimant to ask for comments on the Respondent’s correspondence. The Claimant has failed to respond to the letter. She has not provided any explanation as to why there has been an ongoing failure to comply the directions or sought a hearing to challenge the strike out application.[4]The claim is therefore struck out and the hearing that was due to start on 27 September 2022 will be cancelled.
