JUDGMENT

[1]The Respondent has failed to file an ET3 and Grounds of Resistance in this case.[2]Having considered the details provided in the claim form (ET1) Employment Judge Adkin has decided that a determination of the claim can properly be made without a hearing and the Judgment of the Tribunal, made under rule 21 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, is as set out below.[3]The Respondent has:a. Unfairly dismissed the Claimant pursuant to section 94 of the Employment Rights Act 1996 and must pay the Claimant a basic award of £6,231, a compensatory award of £3,149.41 and loss of statutory rights in the sum of £450.b. In breach of contract failed to pay notice pay of £4,515.00.c. Unlawfully failed to pay wages to the Claimant in the sum of £1,354.40 and unlawfully failed to pay holiday pay of £1,420.65.[4]The Respondent is ordered to pay the Claimant £17,120.56 having accounted to HMRC for any tax and national insurance due.
