[1]The claim of sex discrimination is dismissed on withdrawal.[2]The Claimant was dismissed by reason of capability. The dismissal was unfair.[3]Had a fair procedure been operated the Claimant would have remained in employment for 4 1/2 months. Thereafter, there is a 25% chance that she would have remained in employment.[4]The Claimant is awarded a basic award of £1,467.[5]The Claimant is awarded a compensatory award of £40,181.80.[6]The Respondent made an unlawful deduction from the Claimant’s wages. The Claimant is awarded £557.47 (gross).[7]The Claimant is awarded the total sum of £40,739.27.
