JUDGMENT
The judgment of the Employment Tribunal is that:(1) the Claimant’s application for interim relief pursuant to section 128 of the Employment Rights Act 1996 fails;(2) this claim will be consolidated with claim number 2207244/2021 and there will be a case management hearing listed in both claims on 25 January 2022. JUDGMENT AT OPEN PRELIMINARY HEARING[1]The Tribunal finds that the Claimant was not an employee of the Respondent within the meaning of s.230 of the Employment Rights Act 1996.[2]The Tribunal therefore has no jurisdiction to hear her claim for automatically unfair dismissal under s.103A of the Employment Rights Act 1996 and the claim is dismissed.
