[1]No response to the claim has been presented. This is despite the claim not only having been served on the respondent but also despite the tribunal subsequently having emailed the respondent on an email address provided at the tribunal’s request by the claimant. No reply was received from the respondent.[2]Pursuant to Rule 21 of the Employment Tribunal Rules 2013, the claimant’s complaints of unpaid wages and holiday pay succeed.[3]An award of £2,820.72 (before tax) is made, payable by the respondent to the claimant, comprising:a. 185.76 hours’ unpaid wages at £12 per hour; andb. 49.30 hours’ unpaid holiday pay at £12 an hour.[4]The hearing set for 24 February 2022 is therefore vacated and will not take place.
