JUDGMENT

The Judgment of the Tribunal is as follows: The Respondent is ordered to pay the Claimant the sum of £689.12 forthwith. That sum is made up as follows:- Unlawful deductions from wages £397.50 Unpaid notice pay £162.19 Untaken holiday entitlement £129.43

REASONS

[1]The Claimant works in the Respondent’s shop in Fulham Broadway. He was employed by him from 21 May 2017 to 11 July 2017. On 16 September 2017, the Claimant brought a claim in the London Central Employment Tribunal against the Respondent claiming unpaid wages, unpaid notice and unpaid holiday entitlement. The Respondent never submitted a response to the claim.[2]The Claimant gave evidence before the Tribunal on oath and produced original documents recording the hours worked. From this, the Tribunal deduced the following facts:- The Claimant worked for the Respondent from 21 May 2017 to 11 July 2017. During that period he worked for 173 hours, at an hourly rate of £7.50. This Case Number: 2207170/2017 means that the total pay he should have been paid was £1,297.50. In fact he was paid £900, leaving a shortfall of £397.50.
