JUDGMENT
The Employment Tribunal enters Judgment against the Respondent in default of the Respondent entering a Response to these claims. The Respondent is ordered to pay the Claimant the sum of £1,004.50 comprising £802.50 in respect of unlawful deductions from wages suffered by the Claimant and £202 in respect of unpaid statutory annual leave entitlement.REASONS
[1]By a Claim Form presented to the Employment Tribunal on 13 September 2017 the Claimant complains about her treatment by the Respondent, her former employer, in a number of respects arising out of two short periods of working as a member of the Respondent’s kitchen staff in their Knightsbridge Budda Bar establishment. It transpired that the claim is exclusively about unpaid wages and holiday pay.[2]The Respondent has not entered a Response to the claim nor attended this hearing. In such circumstances the Claimant is entitled to a Judgment in her favour.[3]I received testimony from the Claimant in person and under oath verifying the details of her claims as set in section 8.2 of the Claim Form.[4]I am satisfied that the Claimant is owed £135 in respect of her first spell of employment with the Respondent between 30 March and 7 April 2017 relating to 18 hours of work which the Respondent has failed to pay and failed to explain or seek to justify its default; 10.7 Judgment with reasons – rule 62 1 Case Numbers: 2207136/2017 £667.50 relating to 89 hours of work between 22 April and 5 May 2017 which the Respondent has failed to pay and failed to explain or seek to justify its default; and £202 in respect of unpaid annual leave referable cumulatively to those two spells of work. .[5]The Judgment of the Tribunal is to award the Claimant the amounts to which she is entitled as set out within the above Judgment.
