JUDGMENT
On hearing Ms L James of the Free Representation Unit on behalf of the Claimant and Mr J Villanueva, representative, on behalf of the Respondent, it is adjudged that:(1) The Respondent is correctly identified as stated above and the claim form and title of the proceedings are amended accordingly.(2) Claimant’s complaint of an unauthorised deduction from wages in respect of an assignment on 13 April 2017 is dismissed – (a) the sum claimed not having been ‘properly payable’ within the meaning of the Employment Rights Act 1996 (‘the 1996 Act’), s13(3), (b) and the complaint being in any event out of time (the alleged deduction not forming with the further, timeous, deductions referred to in para(3) below, part of a ‘series of deductions’ within the meaning of the 1996 Act, s23(3)(a)). (3) The Claimant’s complaints of unauthorised deductions from wages in respect of assignments on 1 and 7 June 2017 are well-founded and the Respondent is ordered to pay to him in respect thereof the total sum of £178.00.(4) The Claimant’s claim for ‘overtime’ payments is dismissed on withdrawal.
