JUDGMENT

The Claimant’s claim for wages is well-founded and the Respondent shall pay to the Claimant the gross sum of £4,166.67

REASONS

[1]I gave leave to the Respondent to defend the claim out of time, by extending time so as to validate the late ET3. This was because I was satisfied that the ET1 had been served at the old address and had not been received.[2]The Claimant pursues no claim in respect of notice. The Respondent asserts gross misconduct as a defence to the notice claim, but cannot rely on the same in respect of the wages claim for September 2018. It is accepted that the Claimant was not paid, even though I am told that HMRC have been paid tax and NI. It is, therefore, necessary to declare that this wages claim succeeds.
