This has been a remote hearing which has been consented to by the parties. The form of remote hearing was V-video (CVP). A face to face hearing was not held because it was not practicable during the pandemic and all issues could be determined in a remote hearing. Following the hearing of oral evidence from the claimant Mr R Uddin (translated by Mr N Deb) and Mr A Bakkar for the respondent, the decision of the tribunal is that:(1) The claim for breach of contract (unpaid wages/holiday pay) fails and is dismissed (Employment Tribunals Extension of Jurisdiction (England and Wales) Order 1994).(2) The claim for unauthorised deduction of wages (unpaid wages/holiday pay) (S.23 Employment Rights Act 1996) fails and is dismissed.
