JUDGMENT

[1]The respondent breached the claimant’s contract in failing to pay him 4 weeks’ notice pay. The respondent is ordered to pay to the claimant the net amount, without deduction of tax, of £1,626.60.[2]The respondent made unlawful deductions from the claimant’s wages as set out below, which the respondent is ordered to pay to the claimant on net basis, without deduction of tax:a. in respect of his pay for the period from 1 July to 7 August 2018; 5 weeks’ net pay (including an average ‘tronc’ payment) of £2,033.25;b. in respect of 14 days, or 2.8 weeks’ accrued but untaken holiday, of Case Number 2206675/2018 £1,138.63, again net.[3]Pension contributions (both employer and employee contributions, the latter being deducted but never paid into the claimant’s pension) for the period January to August 2018 of £498.80.[4]The total award (1 to 3) is therefore £5,297.27 net, with no deduction for taxes.
