JUDGMENT

[1]The respondent has failed to file an ET3 Grounds of Resistance in this case.[2]Having considered the ET1, REJ Wade has decided that a determination of the claim can properly be made without a hearing and the Judgment of the Tribunal, made under rule 21 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, is as set out below.[3]The respondent has unlawfully failed to pay wages to the claimant and the tribunal orders the respondent to pay him 1.25 months’ pay for the period before the factory was shut and the employment terminated of £3,250 net and to account to /HMRC for the tax and NI due.[5]The Respondent’s failure to pay wages has resulted in the clamant sustaining financial loss (Employment Rights Act 1996, section 24(2)) and the tribunal orders it to pay him £2,775.
