JUDGMENT
[1]The claim for unpaid wages for the period is upheld. The respondent failed to pay the claimant’s wages for the period 23 August – 13 September 2019. The claimant is awarded £516 gross pay (64.5 hours x £8/hour).[2]The claimant was unfairly dismissed for asserting a statutory right. He is awarded for his unfair dismissal a compensatory award of £480. (On reconsideration, he is not entitled to a basic award as I first thought, because he does not have one year’s service.)[3]The recoupment regulations may apply to the unfair dismissal award. The tribunal office has been unable to get in contact with Mr Omoshebi to establish whether he claimed benefits between jobs. If he did, the prescribed period is 14 – 30 September 2018 and the prescribed element is £480.
