JUDGMENT

[1]The respondent breached the appellant’s contract of employment in failing to pay him in lieu of two weeks’ notice. The respondent is ordered to pay the claimant £751.40 net, without deduction of tax.[2]The respondent made the following unlawful deductions from the claimant’s wages, which the respondent is ordered to pay to the claimant:a. pay in the period from 1 July to 7 August 2018, which is 5 weeks’ wages (including a ‘tronc’ payment) of £1,878.50, net, without deduction of tax; Case Number 2206463/2018b. 7 days or 1.4 weeks’ holiday pay of £525.98 (net);c. Employers and employees’ pension contributions (the latter being deducted from the claimant’s pay but never paid into his pension) in the period 1 January 2018 to 31 July 2018: £303.34 (net)[3]The total award that the respondent is ordered to pay the claimant (1 and 2(a) to (c) above) is therefore £3,459.22, net, without deduction of tax.
