JUDGMENT

[1]The correct Respondent is PGD Food Services Limited.[2]The Respondent did not provide a response form and did not attend the hearing. This is despite the Tribunal sending a reminder to the Respondent by post on 28 October 2021 and by email (using an address provided by the Claimant) on 23 November 2021.[3]Having considered the ET1 and the background, the Tribunal decided that a determination of the claim could be made at the hearing without the Respondent’s response. The Judgment of the Tribunal, made under rule 21 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, is as set out below.[4]The Respondent made an unauthorised deduction from the Claimant’s wages in relation to the period from 1 July 2021 to 11 August 2021. This includes salary for the period worked from 1 July 2021 to 2 August 2021 (inclusive) and for 7 days’ annual leave taken by the Claimant from 3 August to 11 August 2021 (inclusive).[5]The Respondent is ordered to pay the gross sum of £2,388 being the amount unlawfully deducted. The Respondent is entitled to make deductions for income tax and national insurance as required by law. Case No: 2206323/2021
