JUDGMENT

[1]The respondent has made unlawful deductions from the claimant's wages by failing to pay to the claimant:a. her salary for April – July 2021 in the total sum of £14,026 (gross)b. for accrued but untaken holiday in the total sum of £3,808.83 (gross) and is ordered to pay to the claimant the gross sum of £17,834.83, in respect of the amount unlawfully deducted, and account to HMRC for any tax and NI due.[2]The respondent was in breach of contract by failing to pay to the claimant for her notice period and is ordered to pay to the claimant the sum of £5,000 (gross), being damages for the breach of contract, and account to HMRC for any tax and NI due.[3]The respondent was in breach of contract by failing to make pension contributions on behalf of the claimant and is ordered to pay to the claimant the sum of £1,485 (net), being damages for the breach of contract. Case Number 2206290/2021[4]The respondent was in breach of contract by purporting to deduct from the claimant’s salary employee pension contributions but failing to remit those to the pension scheme provider and is ordered to pay to the claimant the sum of £1,800 (net), being damages for the breach of contract.
