JUDGMENT
[1]Having accepted that Bruton Restaurant Ltd (in voluntary liquidation) was his employer at all relevant times, the Claimant withdrew his claims against Season Dreams PLC and Project Re Ltd. and accordingly, all claims against Season Dreams PLC and Project Re Ltd. are dismissed upon withdrawal.[2]The Claimant’s complaint against Bruton Restaurant Ltd (in voluntary liquidation) under section 23 of the Employment Rights Act 1996 that his employer made a deduction from wages in contravention of section 13 of the Employment Rights Act 1996 is well founded.[3]Bruton Restaurant Ltd must pay the Claimant the total sum of £5,569.48 representing unpaid net wages consisting of the following:a. £3,383.33 for net wages due for April 2022b. £2,186.15 for net wages due for the period 1 to 19 May 2022 when his employment ended (based on daily rate).[4]The Tribunal makes a declaration under s.12(3)(a) of the Employment Rights Act 1996 that Bruton Restaurant Ltd. has failed to give the Claimant pay statements in accordance with s.8 of the Employment Rights Act 1996 in respect of the period 1 January 2022 to 19 May 2022 referred to immediately above.
