The claim is struck out.REASONS
[1]By a letter dated 3 November 2023 (sent by email), the tribunal gave the claimant an opportunity (14 days) to make representations or to request a hearing, as to why the claim should not be struck out because:• the claimant had not complied with the tribunal’s orders• the claim has not been actively pursued.[2]Although the tribunal’s email was, due to an administrative error, not in fact copied to the claimant, it was copied to the respondent and to other claimants in linked claims. The respondent then on 6 November 2023 forwarded the tribunal’s email to the claimant at the email address given for him on the tribunal’s records. In addition, the respondent delivered it on 7 November 2023 to the claimant’s postal address and it was signed for by someone called “Scott”. The claimant has therefore been provided with that notice, with effect from 6 November 2023.[3]It is now well in excess of 14 days since the claimant received the tribunal’s notice and he has failed to make representations in writing why the claim should not be struck out or to request a hearing. The claim is therefore struck out. 8 December 2023
