JUDGMENT
[1]The respondent has failed to file an ET3 Grounds of Resistance in this case.[2]Having considered the ET1, REJ Wade has decided that a determination of the remaining claims can properly be made without a hearing and the Judgment of the Tribunal, made under rule 21 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, is as set out below.[3]The respondent has unlawfully failed to allow the claimant to take holiday to which he was entitled and the tribunal awards compensation under the Working Time Regulations 1998, Regulation 30(4). The sum which is just and equitable in the circumstances is the value of the holiday pay which the claimant did not receive.[4]The Tribunal orders the respondent to pay her the sum of £673.79 and to account to /HMRC for any tax and NI due.
