[2]Upon the Claimant affirming that the facts contained in his ET1 were true, I ordered that the Respondent do pay to the Claimant unpaid wages for the period 15 July to 2 August 2019 of £978.50 gross and holiday pay for the period 2 to 15 July 2018 of £1,201.75 gross, a total amount of £2,180.25 gross.REASONS
[1]On 5 December 2018, the Employment Tribunal informed the Claimants in the following three cases that, on reviewing the files of the following claims: i. Mr T Hannachi – Claim number 2206196.2018 ii. Mr O Omoshebi – Claim number 2206539.2018 iii. Mr R Sta Cruz – Claim number 2206060.2018 Employment Judge Potter was of the opinion that the claims could be considered together because they appear to give rise to common or related issues of fact and law.[2]An insolvency administrator, Mr Glenn Adams of Quantuma LLP of Meridient House, Ground Floor, 69-71 Clarendon Road, Watford, Herts, 10.7 Judgment with reasons – rule 62 March 2017 Case No: 2206060/2018 WD17 1DS provided the Tribunal on 20 December 2028 with a signed notice of deemed consent to place the Respondent company into Liquidation. This notice was filed in relation to all three claimants listed above.[3]This notice was followed by a letter from Quantuma LLP dated 24 December 2018 attaching a Statement of Affairs for the Respondent company. The letter came from Mr Nick Simmonds of Quantuma LLP at 81 Station Road, Marlow, Bucks SL7 1NS giving reference NCS/CRN/MQM/CAW/6003894/101.[4]On 18 January 2019, Mr Glenn Adams of Quantuma LLP emailed to inform the Employment Tribunal that the Respondent company was in liquidation and attaching a copy of appointments for information. The Certificate of Appointment was dated 8 January 2019 and certified that the creditors of the Respondent company decided via the deemed consent procedure on 7 January 2019 that Mr Simmonds and a Mr Chris Newell, both of Quantuma LLP at 81 Station Road, Marlow, Bucks SL7 1NS, be appointed Joint Liquidators of the Respondent company.[5]Today, I heard evidence from the Claimant to the effect that the information contained in his ET1 was true to the best of his knowledge and belief.[6]Accordingly, I uphold the claim for unpaid wages for the period 15 July to 2 August 2019 of £978.50 gross and for holiday pay for the period 2 to 15 July 2018 of £1,201.75 gross, a total amount of £2,180.25 gross.
