JUDGMENT

The Tribunal declares that the Respondent has made an unauthorised deduction from the Claimant’s pay in respect of her overtime. The Respondent concedes that it breached the Claimant’s contract by failing to pay her for the full period of her fixed term contract. Accordingly, the Respondent must pay to the Claimant the following sums:[1]The gross sum of £3,276.31 in respect of her overtime;[2]The gross sum of £1980 by way of damages for breach of contract. Case Number: 2206058/2018 In each case the sums must be paid to the Claimant in full, without deductions, save for any deductions for Tax and Employees National Insurance which are properly due on the sums in question and which are paid to HMRC and for which the Claimant is given evidence of such payment. The Respondent must also pay the Claimant the sum of £1,833 being the amount of her preparation time which is ordered to be paid pursuant to rule 76 of the Employment Tribunals (Constitution & Rules of Procedure) Regulations 2013.
