JUDGMENT
[1]The respondent has failed to file an ET3 Grounds of Resistance in this case.[2]Having considered the ET1, EJ Stout has decided that a determination of the claim can properly be made without a hearing.[3]The Judgment of the Tribunal, made under rule 21 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, is that the Respondent has unlawfully failed to pay wages and holiday pay to the Claimant.[4]The Tribunal orders the Respondent to pay to the Claimant a total of £31,656.92, comprising:4.1 Wages of £28,500 net (5 months’ salary at £5,700 per month after tax/NI deductions);4.2 Holiday pay of £3,156.92 net (comprising 12 days holiday pay; annual entitlement 30 days pro rata for six months’ employment = 15 days, less three days taken) 4.17 Rule 21 judgment – universal template Case No: 2205841/2019
