JUDGMENT
Following the hearing of oral evidence from the Claimant and legal submissions from Counsel for the claimant, the judgment of the Tribunal is that:(1) The respondent failed to consult with the claimant as a person who may be affected by proposals to dismiss, or measures taken in connection with the dismissal of 20 or more employees, in breach of section 188 of the Trade Union and Labour Relations (Consolidation) Act 1992.(2) Under section 189(1),(2),(3) and (4) of the Trade Union and Labour Relations (Consolidation) Act 1992, the Tribunal a makes a protective award in respect of the claimant and the respondent is ordered to pay remuneration to the claimant for a protected period of 90 days beginning on 13 May 2020 in the sum of £12,870.(3)The Employment Protection (Recruitment of Jobseeker’s Allowance and Income Support) Regulations 1996 apply to this award.
