JUDGMENT
[1]No response to the claim was presented by the respondent. Judgment under rule 21 of the Employment Tribunal Rules 2013 was therefore entered. The claimant’s complaints of unpaid wages and unpaid holiday pay succeed. Furthermore, the tribunal makes declarations that the respondent failed to provide the claimant with itemised pay statements and made unauthorised deductions from her wages. The tribunal also makes an award under section 24(2) of the Employment Rights Act 1996 to compensate the claimant for financial loss sustained by her which is attributable to the deductions from wages complained of (specifically her postal expenses in relation to her letter before action to the respondent).[2]The tribunal makes a total award of £363.63 (net), payable by the respondent to the claimant, which comprises:a. £247.25 (net unpaid holiday pay);b. £109.88 (net unlawful deductions from the claimant’s wages); andc. £6.50 (the claimant’s postal expenses).
