JUDGMENT

[1]The Tribunal finds that as at 22 May 2019, the effective date of termination of what the Claimant says was a contract of employment, that she did not have required two years’ qualifying service pursuant to section 108 of the Employment Rights Act 1996 (ERA) to enable her to bring a claim of unfair dismissal.[2]Further, the Tribunal finds that the claim of unfair dismissal was not presented to the Tribunal before the end of the period of three months beginning with the effective date of the termination, or within such further period as the Tribunal considers reasonable in a case where it is satisfied that it was not reasonably practicable for the complaint to be presented before the end of that period of three months in accordance with section 111 (2) of the ERA.[3]The Claimant’s claim of unfair dismissal therefore fails in the absence of the Tribunal having jurisdiction to hear it and is accordingly dismissed.
