JUDGMENT

Unlawful Deductions claim The Claimant’s claim for unlawful deductions succeeds and the Respondent is ordered to pay the Claimant a total of £4,458.50 gross, (subject only to any deductions for monies which are properly and lawfully due on that sum by way of tax and employee’s national insurance and which have been remitted to HMRC). The Claimant was paid the sum of £2070 per month which amounts to £95.54 per day and accordingly the sum of £4,458.50 is made up as follows:1.1 £2,738.78 gross by way of arrears of wages for the period from 1 April 2018 to 9 May 2018 (being one month at £2070 and 7 days in May at £95.54 per day); and1.2 18 days holiday pay outstanding on the termination of the Claimant’s employment being £1,719.72 at £95.54 per day. 10.2 Judgment - rule 61 February 2018 Case No:2205033/2018 The Respondent must produce evidence of any monies deducted and paid to HMRC to the Claimant.
