JUDGMENT
[1]The respondent has failed to file ET3 Grounds of Resistance in this case.[2]Having considered the ET1, EJ Wade has decided that a determination of the claim can properly be made without a hearing.[3]The Judgment of the Tribunal, made under rule 21 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, is that the respondent has unlawfully failed to pay wages to the claimant.[4]The tribunal orders the respondent to pay her:4.1 Wages of £775.72 net wages for July/ August4.2 Wages of 509 net for August/ September overtime4.3 Wages of £532 gross for September deductions for tax and NI must be made as appropriate.[5]The tribunal has jurisdiction to award compensation for expenses arising out of the failure to pay and if the claimant provides a figure and supporting evidence this judgment can be varied to award a further sum.[6]The hearing listed for 9 March 2020 will not take place because judgment has been given and the parties should not attend. 4.17 Rule 21 judgment – universal template Case No: 2204784/2019
