[3]The respondent has not responded to this claim, or to similar claims by co-workers, although proceedings were served at the registered office on 27 October 2021. This judgment is made under rule 21.[4]The claimant was employed by the respondent from 26 February 2019 at a wage of £311.25 per week.[5]On 8 April 2020 her employment terminated, on being given notice by letter of 6 April 2020.[6]She was entitled to one month’s notice of termination by virtue of the contract.[7]The contract of employment was provided to her in April 2020[8]The claimant has not been paid for the notice period.[9]The claimant is entitled by contract to one month’s pay in lieu of notice, £1,348.75 gross.[10]There is a claim under section 38 of the Employment Act for failing to provide a statement pf employment particulars. The Act provides for an award of 2-4 weeks pay if the statement of particulars required by section 1 of the Employment Rights Act 1996 had not been provided when proceedings were begun. However, a statement was provided at or before the dismissal in April 2020. Proceedings began on 6 August 2020. 10.2 Judgment - rule 61 Case No: 2204774/20 By that date the statutory particulars had been provided. There is no award.
