JUDGMENT

[1]The claim of constructive unfair dismissal is dismissed. The Tribunal does not have jurisdiction to hear the claim because:a. The claim was not presented to the Tribunal within the time period stipulated at section 111(2)(a) of the Employment Rights Act 1996;b. The Tribunal is not satisfied that it was not reasonably practicable for the complaint to be presented before the end of that period; andc. In any event, the complaint was not presented within a further period that the Tribunal considers reasonable.[2]The claim of discrimination arising from disability in relation to the events of 16 April 2021 was presented to the Tribunal within the time period stipulate at section 123(1) of the Equality Act 2010, because it was presented within such further period as the Tribunal thinks just and equitable.
