JUDGMENT

[1]The respondent has failed to file an ET3 Grounds of Resistance in this case.[2]Having considered the ET1, REJ Wade has decided that a determination of the claim can properly be made without a hearing and the Judgment of the Tribunal, made under Rule 21 of the Employment Tribunals (Constitute and Rules of Procedure) Regulations 2013, is as set out below.[3]The respondent has failed to pay the claimant monies that are owed to her.[4]The Tribunal orders the respondent to pay the claimant £15,960.00 consisting of:a. Statutory redundancy payment (£6,825.00)b. Notice pay (£6,825.00)c. Arears of Pay from 1st – 30th March 2020 (£2,310.00)d. Holiday pay (£535.00) and to account to HMRC for the tax and national insurance due on this amount.[5]The hearing listed for 27th September 20211st October 2021 will not take place and the parties should not attend. _____________________________ Regional Employment Judge Wade Date: 17th September 2021[1]No response to the claim has been presented and the liquidator of the respondent has confirmed that it has no objection to these proceedings continuing. Pursuant to Rule 21 of the Employment Tribunal Rules 2013, and subject to the paragraph below and the provisions set out in the respective schedules annexed to this judgment, the claimants’ complaints of unfair dismissal, for a statutory redundancy payment, for notice pay, for arrears of pay and for unpaid holiday pay succeed.[2]Ms Kimberley Johnson’s complaint of maternity discrimination and Ms Olga Olshevska’s complaint of unpaid holiday pay are dismissed upon withdrawal by the claimants.[3]The awards in the schedules annexed to this judgment are made in respect of the 8 claimants, all payable by the respondent to, in each case, the claimant whose name appears in the respective schedule.[4]The hearing set for 27 September 2021 is vacated and will not take place. 20 September 2021
