JUDGMENT

[1]The claimant was employed by the respondent from 2 January 2019 until she was dismissed by the respondent with effect from 2 August 2019.[2]The claimant’s complaints of direct disability discrimination and of discrimination arising from disability fail.[3]The claimant’s complaints of unpaid annual leave, unlawful deduction from wages and breach of contract in respect of notice pay all succeed.[4]A total award of £1,277.55 (gross) is made, payable by the respondent to the claimant. This comprises:a. £714 (gross) (being 14 days’ accrued but unpaid holiday pay (including 4 bank holidays));b. £53.55 (gross) (being unpaid wages due at the termination of the claimant’s employment); andc. £510 (gross) (being two weeks’ notice pay).[5]The respondent’s employer’s contract claim is struck out.
