[1]The respondent has failed to file an ET3 Grounds of Resistance in this case.[2]Having considered the ET1, Tribunal Judge McGrade has decided that a determination of the claim can properly be made without a hearing and the Judgment of the Tribunal, made under rule 21 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, is as set out below.[3]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the gross sum of £37,698.91.[4]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the gross sum of £3,726.06.[5]The respondent is in breach of contract and is ordered to pay to the Claimant the gross sum of £12,274.08 in respect of notice pay.
