JUDGMENT
The Claimant’s claim is struck out pursuant to Rule 37(d) of the Employment Tribunals (Constitution & Rules of Procedure) Regulations 2013 on the basis that it has not been actively pursued.REASONS
The Respondent applied to the Tribunal as they had been unable to contact the Claimant and he had failed to answer their correspondence. The Respondent understood that both ACAS and his former representatives had not been able to contact the Claimant. The Tribunal wrote to the Claimant explaining that the Judge was considering striking out the claim on the basis that it had not been actively pursued and ordered the Claimant to write to the Tribunal by no later than 24 February 2023 if he still wished to continue the claim. The Claimant did not write to the Tribunal. In the circumstances the Claimant is not actively pursuing the claim and it should be struck out in its entirety pursuant to Rule 37(d) of the Employment Tribunals (Constitution & Rules of Procedure) Regulations 2013.
