JUDGMENT
[1]The claim is amended in respect of the respondent’s name to KBROOK GROUP LTD.[2]The respondent’s application for an extension of time to file its ET3 response form is granted.[3]The claimant is not an employee within the meaning of section 230(1) and (2) of the Employment Rights Act 1996 and therefore the Tribunal has no jurisdiction to hear the claims for unfair dismissal or redundancy payment.[4]The claimant is a worker within the meaning of section 230(3)(b) of the Employment Rights Act 1996.[5]The claim for unlawful deduction of wages and holiday pay succeeds.[6]The respondent must pay the claimant £ 1,610 (gross).
