JUDGMENT
(1) Masterclass Hospitality Ltd T/A Hora London (In Voluntary Liquidation) failed to comply with any of the requirements of section 188 and section 188A of the Trade Union and Labour Relations (Consolidation) Act 1992 (TULRCA).(2) The Respondent shall pay each Claimant listed below 90 days’ pay, with a commencement date of 27 April 2025.(3) The recoupment provisions apply to the period 27 April 2025 to 13 January 2026.(4) Claims 2204059/2025 & 2204060/2025 are simply duplicates of 2204053/2025, 2204054/2025 and there is no separate award. - 1 -REASONS
[1]For reasons given orally I am satisfied that the complaints are made out. In short I accepted Mr Rezene’s evidence that there was one relevant establishment at which there were over 30 employees working who were all suddenly made redundant by the insolvency of the Respondent, or at least affected by it.[2]There was no consultation at all.[3]I am satisfied that the appropriate award for all Claimants is 90 days’ pay which is the maximum amount under section 189(4) TULRCA 1992.[4]The Schedule attached contains the names of the relevant Claimants.
