The claim is struck out.REASONS
[1]The claimant failed to attend the preliminary hearing on 28 July 2021 without explanation or notice. The claimant also failed to comply with the tribunal’s orders dated 14 June and 30 July 2021.[2]By a letter dated 31 July 2021 the tribunal wrote to the claimant to warn her that it was considering striking out the claim in its entirety because it was not being actively pursued (rule 37(1)(d)). The claimant was invited to make representations or to request a hearing as to why the claim should not be struck out and ordered to do so by 14 August 2021. This letter also warned the claimant that if she failed to respond within this deadline the claim would be struck out without further notice.[3]The claimant failed to reply. The claim is therefore struck out.[4]The preliminary hearing listed on 5 November 2021 will not take place.
