JUDGMENT
(1) The claimant’s claim for 9 days for days worked from 21 - 30 September 2021 was submitted outside the time limit for such claims and therefore fails and is dismissed.(2) The claimant’s claim for holiday pay succeeds. He should have received pay for 6.33 days on termination of his employment. His gross daily rate was £123 per day and so the amount he is owed is £778.59 gross.(3) The claimants claim for pay for the month of May 2022 succeeds. He worked 4 days and so is entitled to 4 x £123 which comes to £492 gross(4) The respondent is ordered to pay the claimant £1,270.5 in total within 14 days less any deductions for tax and national insurance contributions, for which the respondent must account to HMCR.
