JUDGMENT
[1]The Respondent has failed to file an ET3 and Grounds of Resistance in this case.[2]Having considered the ET1, Regional Employment Wade has decided that a determination of the claim can properly be made without a hearing and the Judgment of the Tribunal, made under rule 21 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, is as set out below.[3]The Respondent has unlawfully failed to pay wages and holiday pay to the Claimant.[4]The Tribunal orders the respondent to pay to the Claimant:a. Unpaid wages of £1,940.44 netb. Holiday pay of £800 gross[5]The Respondent is ordered to pay the Claimant £2740.44 and to account to HMRC for any tax and NI due on this sum.[6]No award is made for the claim for £500.00 for stress as the Tribunal does not have jursidiction to award this.[7]The hearing on 12 September 2022 is vacated and the parties should not attend.
