JUDGMENT

[1]The Respondent has failed to file an ET3 and Grounds of Resistance in this case.[2]The Respondent initially complained that it had not received Notice of the claim. Copies of the relevant documents were sent to the Respondent on 29 July 2022 and acknowledged, but no Response has been received.[3]In the absence of a Response from the Respondent and having considered the Claim form ( ET1), EJ Spencer has decided that a determination of parts of the Claimant’s can properly be made without a hearing.[4]It is adjudged that :a. The Claimant has less than two years service and is not entitled to bring a claim of unfair dismissal. That claim is dismissed.b. The Claimant’s claim for unpaid wages succeeds and the Respondent is ordered to pay the Claimant £3,437.30.c. The Claimant’s claim for holiday pay succeeds and the Respondent is ordered to pay the Claimant £222.12.d. The Claimant’s claim of disability discrimination shall proceed to a hearing. A separate case management order has been issued in respect of this part of the claim.[5]The Tribunal orders the Respondent to pay a total of £3,659.62 to the Claimant. ............................................................
