JUDGMENT

[1]The Respondents have failed to file an ET3 in this case.[2]Having considered the ET1 and grounds of complaint, Employment Judge Brown has decided that a determination of the claim can properly be made without a hearing and the Judgment of the Tribunal, made under rule 21 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, is as set out below.[3]The Respondents unlawfully failed to pay the Claimant’s wages in the sum of £1615.00.[4]The Respondents are ordered to pay the Claimant £1615.00 and to account to HMRC for any tax and NI due on this sum.[5]The Respondents are also ordered to pay the Claimant £745.38, being 2 weeks’ wages, pursuant to s38 Employment Act 2002, because the Respondents were in breach of their duty to the Claimant under s1 Employment Rights Act 1996 to provide her with a statement of employment particulars when the proceedings were begun.[6]The hearing on 25 November 2022 is vacated and the parties should not attend.
