JUDGMENT

[1]The claims are struck out.[2]The trial listed for 1, 2 and 3 March 23 is cancelled

REASONS

[1]The trial was adjourned (for the second time) on 13/9/22 as the Claimant had failed to comply with pre-trial directions.[2]On that occasion the Tribunal issued fresh directions for the Claimant to provide further particulars, a schedule of loss, disclosure and an impact statement by 11/10/22 and the EJ warned the Claimant that if she did not comply her claims would be struck out. This was her last chance to take her claims to trial. This warning was repeated in paragraph 7 and its footnote of the CMO issued on 13/9/22.[3]The Claimant has failed to comply with the fresh directions by 11/10/22 or at all and on 31/10/22 the Respondent applied for the claims to be struck out, which application was copied to the Claimant, who has not responded.[4]The claims are struck out under Rule 37(b)(c)(d) and (e) J S Burns
