JUDGMENT

[1]The Claimants’ complaint of breach of section 188 of the Trade Union and Labour Relations (Consolidation) Act 1992 (“TULRCA”) is well founded.[2]The Respondent has failed to comply with the requirements of section 188 of TULCRA and is ordered to pay remuneration (protective award) to each of the affected employees named in the table below for the protected period.[3]The protected period shall be a period beginning on 19 March 2020. Considering all the circumstances of the case it shall have the length of 90 days.[4]The remuneration (protective award) due to each of the affected employees, calculated in accordance with section 190 of TULRCA, is set out in the table below.
